Fax to Email Service - Terms and Conditions

Liability: Customer acknowledges that Conexim Australia Pty. Ltd. (referred to as 'Conexim') is not liable forany act or omission of any other company or companies furnishing a portion of any service to the Customer and shall be indemnified and held harmless bythe customer against all claims for liable, slander, infringement of copyright or unauthorized use of trademark, trade name, or service mark arising outof the material, data, information, or other content provided by Customer for the development and or installation of the Customers Web Site. Conexim isnot liable for any acts or claims made by independent authorized Consultants. Conexim makes no expressed or implied warranty of any kind in regard tothese services. Service is rendered on an "as is" basis, without any other warranties, or conditions, express or implied, including but not limited towarranties for merchantable quality, merchantability, or fitness for a particular purpose, or those arising by law, statute, usage of trade, or courseof dealing. The Internet is a very large, unreliable network. Some parts of the Internet will be not working at any given time, and this is outsideConexim's control. Customer accepts that faults will occur from time to time and that Conexim is not liable for any faults experienced in the Coneximnetwork, public phone network or the public Internet. If a fault occurs within the Conexim network, we fix it as soon as possible. By using the Coneximservice, the Customer accepts to be bound by these Terms and Conditions.

Cancellation: Conexim Australia Pty. Ltd. may discontinue hosting or cancel production for a service without incurring any liability for any of the following reasons:

  1. Non-payment of any sum due to Conexim Australia Pty. Ltd. for service.
  2. Abuse of service
  3. A violation of any law, rule or regulation of any governing authority having jurisdiction over the service.
  4. By order of a court or other governmental or quasi-governmental authority having such jurisdiction.
  5. The Customer provides false or misleading credit information.

Conditions of use:
You will be allocated a non-portable phone number. You affirm that no demand will ever be made by you for ownershipand/or portability of the Conexim telephone number assigned to you. You understand and agree that upon the termination of your service, for anyreason, the telephone number assigned to you may be IMMEDIATELY reassigned to another customer. You agree that Conexim will not be liable fordamages arising out of any such assignment. You further understand and agree that Conexim may from time to time need to change the Conexim telephonenumber assigned to you.

Conexim may terminate your account with or without cause at any time. Conexim shall have no obligation to maintain anycontent in your account or to forward any unread or unsent messages to you or any third party. You agree that any termination of your access to theConexim service may be effected without any prior notice to you.

You agree to indemnify Conexim, its subsidiaries, representatives and employees from any claim or demand, includingsolicitors' fees, arising out of your use of Conexim services, including any violation of this Agreement by you or any other person using your account,or any claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other customers and infringement of intellectualproperty or other rights.

Marketing:
Customer agrees that Conexim may refer to Customer by trade name and trademark, and may briefly describe Customer's Business, in Conexim'smarketing materials and web site.
